Any dispute arising from or relating to these Terms or the Website shall be resolved exclusively in the courts located in Tel Aviv, Israel. You consent to the personal jurisdiction of such courts and waive any objection to venue in such courts.

14. Binding Arbitration

The arbitration shall be conducted in Tel Aviv, Israel, in the English language. The arbitrator's decision shall be final and binding, and judgment on the award may be entered in any court of competent jurisdiction.

Exceptions: Either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement of intellectual property rights.

15. Class Action Waiver

YOU AND BAR TSVEKER AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION.

Unless both you and Bar Tsveker agree otherwise, the arbitrator may not consolidate more than one person's claims and may not otherwise preside over any form of a class, consolidated, or representative proceeding.

If this class action waiver is found to be unenforceable, then the entirety of the arbitration agreement shall be null and void, and all disputes shall be resolved in the courts specified in the Governing Law section.

16. Assumption of Risk

By using this Website and its tools, you expressly acknowledge and agree that:

  • You are using the Website and tools voluntarily and at your own risk
  • You have read and understood all disclaimers and warnings
  • You are solely responsible for any consequences of using tool outputs

TO THE FULLEST EXTENT PERMITTED BY LAW, YOU AND BAR TSVEKER EACH WAIVE THE RIGHT TO A JURY TRIAL FOR ANY DISPUTE ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE WEBSITE. This waiver applies to any claims that are not subject to binding arbitration under these Terms.

18. Force Majeure

Bar Tsveker shall not be liable for any failure or delay in performing obligations under these Terms due to causes beyond our reasonable control, including but not limited to: acts of God, natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, strikes, shortages of transportation, facilities, fuel, energy, labor, materials, or communications or network failures or interruptions.

19. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by updating the "Last updated" date at the top of this page. Your continued use of the Website after any modifications constitutes acceptance of the updated Terms. We encourage you to review these Terms periodically.

20. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

21. Entire Agreement
